1. Introduction

These Terms & Conditions govern the use of our website, our services, and any course booking made with NextGen HGV Limited.

By using our website, submitting an enquiry, making a booking, paying a deposit, entering into a finance agreement, or accepting any service from NextGen HGV Limited, you agree to these Terms & Conditions.

Please read these terms carefully before booking. If you do not agree with these terms, you should not proceed with a booking.

2. Services Provided

NextGen HGV Limited provides HGV, PCV and CPC course coordination, learner support and training arrangement services.

NextGen HGV Limited works with selected third-party training providers across the UK to arrange practical training and related services. We do not deliver practical vehicle training ourselves. Practical training is delivered by selected third-party training providers, instructors and/or training schools. Practical training may be delivered by independent training providers, instructors, test providers, vehicle providers, medical providers, revision providers or other third parties.

Our services may include, depending on the package purchased:

  • course guidance and onboarding;
  • support with the HGV licence process;
  • DVLA/DVA medical and provisional licence guidance;
  • theory test and hazard perception support;
  • CPC Module 2 and Module 4 support where included;
  • revision material or digital revision access where included;
  • practical training coordination;
  • practical test booking support where included;
  • communication with training providers;
  • learner progress support.

NextGen HGV Limited may refer to its packages as “full course”, “complete package”, “all-inclusive package” or similar wording. This means that the package includes the stages specifically confirmed to you in writing at the point of booking. It does not mean that unlimited retests, unlimited training hours, guaranteed pass results, guaranteed employment, job placement, interviews, recruitment services or unlimited support are included.

3. Career Information and Employment Outcomes

NextGen HGV Limited may provide general information about HGV driving as a career, the logistics sector, licence pathways, potential types of driving work, and general industry opportunities.

This information is provided for general guidance only. It does not form part of the HGV training course package and should not be treated as job placement, recruitment support, employment support, CV rewriting, application support, employer introduction, or a guarantee of work.

NextGen HGV Limited does not guarantee:

  • that you will receive a job offer;
  • that you will receive an interview;
  • that an employer will contact you;
  • that you will pass any employer assessment;
  • that you will be accepted by any recruitment agency or employer;
  • that you will earn any specific salary or income;
  • that work will be available in your preferred location;
  • that work will be available on your preferred shift pattern;
  • that work will be available within a specific timeframe;
  • that newly qualified driver roles will be available immediately after passing.

Any decision to offer employment is made entirely by the employer, recruitment agency or hiring company. NextGen HGV Limited is not responsible for an employer’s hiring decision, recruitment process, salary offer, shift pattern, location, working conditions, reference checks, right-to-work checks, insurance requirements, driving assessments or employment terms.

You remain responsible for applying for roles, attending interviews, responding to employers, maintaining your licence entitlement, providing accurate information, and meeting any employer requirements.

For the avoidance of doubt, job placement, recruitment services, CV rewriting, job application support, employer introductions and employment support are not included as part of the HGV training package.

  1. Data Sharing for Course Administration

    To provide our services, NextGen HGV Limited may need to share relevant information with third parties. This may include training providers, medical providers, revision providers, test providers, finance providers, payment providers, professional advisers or other service providers involved in arranging, managing or administering your course.Information may be shared for purposes including:

  • arranging your course;
  • booking or supporting training stages;
  • arranging medical, theory, CPC or practical stages;
  • providing revision access;
  • managing your learner journey;
  • complying with finance provider requirements;
  • dealing with refunds, cancellations, complaints or customer service matters.

By booking with NextGen HGV Limited, you agree that we may share relevant information where reasonably necessary to deliver your course, manage your booking, support your progress, process payment or finance, and administer your course.

We will handle personal data in line with our Privacy Policy and applicable data protection laws.

5. Booking and Payments

All course bookings must be made through our official website, over the phone, by email, by message, or through an authorised representative of NextGen HGV Limited.

Payment may be made:

  • in full at the time of booking;
  • by deposit followed by agreed balance payments;
  • through an approved finance provider;
  • through another agreed payment method confirmed by NextGen HGV Limited in writing.

A booking is not confirmed until payment, deposit, finance approval, or another agreed payment arrangement has been accepted by NextGen HGV Limited.

Once payment or finance approval is received, confirmation of your booking will be sent by email, message, or another written method.

Where a deposit is paid, the remaining balance must be paid in line with the payment terms agreed with you. Practical training, test bookings, provider bookings or course progression may be delayed until the required balance has been paid.

NextGen HGV Limited reserves the right to pause, cancel or delay a booking where payment has not been made as agreed.

6. Finance Agreements

Where a course is paid for using finance, the finance agreement is between you and the finance provider, unless stated otherwise.

Finance is subject to status, eligibility, affordability checks, finance provider approval, and the finance provider’s own terms and conditions.

NextGen HGV Limited is not responsible for any finance provider’s decision to approve, decline, amend, cancel, suspend or enforce a finance agreement.

If your finance application is declined, your booking may not proceed unless you choose to pay by another accepted payment method.

Where a refund is approved and your course was funded by finance, any refund may be paid directly to the finance provider rather than to you. You remain responsible for complying with the terms of any finance agreement you enter into.

You should read your finance agreement carefully before signing. Any finance repayments, interest, missed payment charges, cancellation rights, default consequences or other finance terms will be governed by the finance provider’s agreement.

Any decision to enter into a finance agreement should be based on your own financial circumstances and ability to repay. General information about HGV driving careers or potential opportunities should not be relied upon as a guarantee of employment, income, future earnings, or ability to repay finance.

 

7. Refunds, Cancellations and Course Changes

A. Your Right to Cancel

If you book a course with NextGen HGV Limited online, by telephone, by email, by message, or without meeting us in person, you may have a legal right to cancel your booking within 14 days of entering into the agreement.

To cancel, you must notify NextGen HGV Limited in writing by email to: [email protected]

If you cancel within the 14-day cancellation period and no work has started on your booking, you will be entitled to a refund of any amount paid.

B. Starting Your Booking Within the 14-Day Cancellation Period

When you book with NextGen HGV Limited, you may ask us to begin work on your booking straight away.

This may include, but is not limited to:

  • issuing your welcome pack;
  • providing DVLA/DVA medical and provisional licence forms;
  • providing theory or CPC revision material or digital access;
  • arranging or supporting your medical appointment;
  • booking or preparing theory, CPC or practical training stages;
  • carrying out administration, onboarding and course coordination work;
  • communicating with training providers regarding your course;
  • creating your customer file.

If you ask us to begin work within the 14-day cancellation period and then decide to cancel, we reserve the right to deduct reasonable costs for any services already provided, work already completed, third-party costs incurred, revision materials issued, tests booked, appointments arranged, provider time reserved, and administration already carried out.

C. Administration Fee

Where a cancellation is made after work has started on your booking, or after the 14-day cancellation period has expired, NextGen HGV Limited may deduct an administration fee of up to £200 from any refund due.

This administration fee covers time spent processing your booking, issuing documents, onboarding you as a customer, liaising with training providers, arranging next steps, preparing your course file, dealing with finance-related administration where applicable, maintaining your customer records where applicable, and dealing with cancellation administration.

D. Medical Failure Refund

If you are unable to continue with the course because you fail the required HGV medical, you may request a refund of the remaining course balance.

Where a refund is due following a failed medical, NextGen HGV Limited will deduct:

  • the cost of the medical appointment, if already booked or completed;
  • any administration fee applicable;
  • any revision materials, digital access, physical materials or documents already supplied;
  • any test fees, booking fees, provider fees or third-party costs already incurred;
  • any onboarding or administration work already completed;
  • any other reasonable costs already paid or committed to in relation to your booking;
  • any finance provider fees, transaction fees, commissions, charges or costs that are non-refundable.

The remaining balance, if any, will then be refunded to you.

You may be asked to provide written evidence that you have failed the medical or are medically unable to continue before a refund is processed.

E. Refunds After Course Work Has Started

Once any part of your course process has started, any refund will be calculated after deducting the value of any work, services, bookings, third-party costs, materials, support or training already provided or committed to.

This may include, but is not limited to:

  • medical appointment costs;
  • theory test fees;
  • CPC test fees;
  • practical test fees;
  • revision material or app access costs;
  • DVLA/DVA, postage or administration support costs;
  • training provider booking costs;
  • practical training hours already booked or delivered;
  • cancellation charges applied by a training provider;
  • finance-related administration work where applicable;
  • any administration fee applicable;
  • any finance provider fees, transaction fees, commissions, charges or costs that are non-refundable.

F. Practical Training and Test Bookings

Practical training dates and test dates are subject to availability and may depend on third-party training providers, DVSA/DVA test availability, instructor availability, vehicle availability, location and the licence category selected.

Once practical training, test dates, vehicle slots or instructor time have been booked, cancellations, postponements or changes may result in additional charges.

Any fees charged by a training provider, test provider, instructor, vehicle provider or other third party may be deducted from any refund due.

If you do not attend booked training, arrive late, cancel at short notice, or fail to provide the required documentation, licence, identification or eligibility evidence, you may lose the booking and no refund may be available for that part of the course.

G. Theory, CPC and Practical Test Failures

Course fees are not refundable because you fail a theory test, hazard perception test, CPC test, practical driving test, driving assessment, or any other training-related assessment.

Unless confirmed in writing as part of your package, retest fees, additional training hours, further revision materials, additional practical training, further vehicle hire, and additional test bookings are not included and may be charged separately.

H. Customer Delays

You are responsible for completing forms, attending appointments, studying for theory/CPC tests, providing requested documents, communicating with NextGen HGV Limited, and attending any booked training or tests.

If your course is delayed because you do not return forms, do not attend appointments, do not study, do not respond to communication, fail to provide documents, or are not ready to proceed, this will not automatically entitle you to a refund.

I. Change of Training Provider or Dates

NextGen HGV Limited works with selected training providers to arrange practical training. We reserve the right to allocate or change the training provider where necessary due to availability, operational requirements, location, vehicle availability, instructor availability, test availability or other reasonable circumstances.

If we need to change your training provider or dates, we will aim to offer a suitable alternative. A change of provider or date does not automatically entitle you to a refund where a suitable alternative is offered.

J. Employment Outcomes Do Not Create a Refund Right

The HGV training package does not include job placement, recruitment services, guaranteed employment, guaranteed interviews, CV rewriting, job application support or employer introductions.

A refund will not be due solely because:

·        you do not secure employment;

·        you do not receive an interview;

·        an employer does not respond to you;

·        you are not offered your preferred role;

·        you are not offered your preferred salary;

·        you are not offered your preferred location or shift pattern;

·        an employer requires more experience;

·        an employer rejects your application;

·        you decide not to apply for available roles;

·        you fail an employer assessment, driving assessment, interview or reference check.

Any career, salary, job-market or employment-related information provided by NextGen HGV Limited is general information only and does not form part of the HGV training package.

K. Finance Agreements

If your course is paid for using finance, any cancellation or refund may also be subject to the terms of your finance provider.

Where a refund is approved and your course was funded by finance, any refund may be paid directly to the finance provider rather than to you.

You remain responsible for complying with the terms of any finance agreement you enter into.

NextGen HGV Limited is not responsible for any finance provider’s decision to approve, decline, amend, cancel or enforce a finance agreement.

L. How Refunds Are Processed

All refund requests must be made in writing by emailing: [email protected]

Refunds will be reviewed on a case-by-case basis, taking into account the stage of your course, work already completed, bookings made, materials provided, third-party costs incurred, services provided, finance administration where applicable, and the reason for cancellation.

Where a refund is approved, we will aim to process it as soon as reasonably possible.

Refunds will usually be made to the original payment method unless otherwise agreed or required by a finance provider.

M. No Refund Where False or Incomplete Information Is Provided

No refund will be due where you are unable to continue because you provided false, inaccurate, incomplete or misleading information about your licence status, medical history, driving eligibility, identity, residency, previous disqualifications, entitlement, or ability to undertake HGV training.

8. Learner Responsibilities

Learners must hold or obtain the correct provisional licence before commencing practical training.

It is the learner’s responsibility to:

  • provide accurate information;
  • attend training on time;
  • comply with provider rules;
  • bring the required documents, licence and identification;
  • notify us of medical conditions or restrictions that could affect training or licensing;
  • study for theory and CPC tests;
  • attend medical appointments, tests and training dates;
  • respond to communication from NextGen HGV Limited;
  • tell us promptly if their circumstances change.

Failure to meet learner responsibilities may delay your course, lead to additional charges, or result in the loss of booked training or test slots.

9. Employment, Earnings and Job Opportunities

NextGen HGV Limited may provide general information about potential career opportunities within the logistics and transport sector. Any examples of salaries, job types, demand for drivers or industry information are provided for general guidance only.

Any salary figures, earning examples, driver demand information or job-market information are not guarantees of income, employment, interviews, job offers or future earnings.

The HGV training package does not include job placement, recruitment services, guaranteed employment, guaranteed interviews, CV rewriting, job application support or employer introductions.

Actual employment outcomes depend on many factors, including location, licence category, experience, employer requirements, insurance criteria, driving record, right to work, availability, attitude, interview performance, references, assessment results and market conditions.

NextGen HGV Limited is not responsible for any loss of earnings, loss of employment opportunity, failure to obtain work, change in job-market conditions, employer decision, recruitment delay or income shortfall.

10. Liability

NextGen HGV Limited will provide its services with reasonable care and skill.

However, NextGen HGV Limited is not responsible for matters outside its reasonable control, including but not limited to:

  • DVSA/DVA test availability;
  • medical outcomes;
  • licence application delays;
  • postal delays;
  • third-party provider delays;
  • instructor availability;
  • vehicle availability;
  • customer delays;
  • test failures;
  • employer decisions;
  • finance provider decisions;
  • changes in law, regulation or testing requirements.

NextGen HGV Limited is not responsible for the delivery of practical training by third-party providers but will aim to work with reputable providers.

We are not liable for any loss of earnings, loss of profit, loss of employment opportunity, additional travel expenses, accommodation costs, childcare costs, missed work, or other indirect losses arising from training delays, cancellations, test failures, medical issues, finance issues, employment outcomes or third-party decisions.

Nothing in these terms limits or excludes liability where it would be unlawful to do so.

11. Intellectual Property

All website content, branding, course materials, documents, guides, written content, graphics, logos and materials provided by NextGen HGV Limited remain the property of NextGen HGV Limited or its licensors.

You may not copy, reproduce, distribute, publish, sell, edit, share or reuse our materials without written permission.

Materials provided to you are for your personal use only in connection with your course.

12. Privacy and Data Protection

We are committed to protecting your personal data in line with our Privacy Policy and applicable data protection laws.

By submitting an enquiry, booking a course, entering into a finance agreement, or using our services, you acknowledge that your information may be processed and shared where necessary to provide our services.

This may include sharing relevant information with:

  • training providers;
  • medical providers;
  • revision providers;
  • test providers;
  • finance providers;
  • professional advisers;
  • service providers involved in delivering or managing your course.

13. Complaints

If you are unhappy with any part of our service, please contact us in writing at: [email protected]

Please include your name, contact details, course details, the issue you are complaining about, and what outcome you are seeking.

We will aim to review complaints fairly and respond as soon as reasonably possible.

Where your complaint relates to a third-party training provider, medical provider, revision provider, test provider, payment provider or finance provider, we may need to refer the matter to that third party or ask them for information before responding fully.

14. Changes to Terms

We may update these Terms & Conditions at any time.

Updated terms will be posted on our website with the effective date clearly shown.

The terms that apply to your booking will usually be the terms in place at the time your booking was made, unless a change is required by law, regulation, finance provider requirement, or another valid reason.
